이러한 새로운 기조는 2025년 1월 23일 서명된 행정명령 14179호, “미국 AI 리더십의 장벽 제거(Removing Barriers to American Leadership in AI)“를 통해 구체화되었다.1 이 행정명령은 바이든 행정부의 기존 지침들을 AI 혁신을 가로막는 “과도한 규제” 및 “장벽“으로 규정하고 5, 모든 연방 기관에 관련 정책의 전면적인 재검토 및 폐지를 지시했다.8

이 행동 계획은 AI를 “산업 혁명, 정보 혁명, 르네상스가 동시에 일어나는 것“으로 규정하며 14, 미국의 최종 목표가 AI 분야에서 “의심할 여지 없는, 도전받지 않는 글로벌 기술 지배력(unquestioned and unchallenged global technological dominance)“을 확보하는 것임을 천명했다.10 이는 AI를 단순한 경제적 도구가 아닌, 국가 안보와 글로벌 패권을 결정짓는 핵심 변수로 간주함을 의미한다.

2.2 3대 핵심 축 (Three Pillars) 상세 분석

’미국의 AI 행동 계획’은 3대 핵심 축을 기반으로 90개 이상의 구체적인 정책 과제를 제시하고 있다.4

제1축: AI 혁신 가속화 (Accelerate AI Innovation)

3. 제1전선 (대외): 국가안보 기반 AI 기술 통제 강화

미국 행정부 교체에도 불구하고, AI 기술의 핵심 기반이 되는 첨단 하드웨어와 자본이 중국 등 전략적 경쟁국으로 유입되는 것을 차단하려는 국가 안보 정책은 정권과 무관하게 초당적인 합의 하에 더욱 강화되고 있다.

3.1 하드웨어 통제: 첨단 반도체(GPU) 수출 통제 현황

Nvidia의 H100, H200과 같은 최첨단 GPU의 중국 수출은 이미 금지된 상태이며 30, Nvidia가 중국 시장을 위해 특별히 개발한 저사양 칩(H20 등) 역시 2025년 5월부로 BIS의 라이선스 요구 대상이 되었다.32 현재 BIS는 Nvidia의 차세대 중국 시장용 칩(B30, B40)에 대해서도 사전 협의를 진행 중이다.32

그러나 2025년 5월 13일, 트럼프 행정부는 이 규칙의 공식 준수일(5월 15일)을 불과 이틀 앞두고 해당 규칙의 전면 철회를 발표했다.40 새 행정부는 이 규칙이 “미국의 혁신을 저해“하고 동맹국들을 “2등 국가로 취급“하여 외교 관계를 훼손하는 “잘못 고안된(ill-conceived) 정책“이라고 강하게 비판했다.44

BIS는 이 지침에서 화웨이(Huawei)의 주력 AI 칩인 Ascend 모델(구체적으로 910B, 910C, 910D)이 미국의 ’해외직접생산품규칙(FDPR)’을 위반하여 생산되었을 가능성이 높다고 공식 선언했다.31 이는 화웨이가 미국의 소프트웨어나 기술, 또는 미국 기술로 만든 반도체 장비를 사용하여 이 칩들을 설계하고 생산했다는 것을 의미한다.31

이 선언의 핵심적인 함의는, 이제부터 전 세계 모든 기업(미국 및 비미국 기업 포함)이 화웨이의 Ascend AI 칩을 사용(use), 판매, 이전, 서비스하는 행위 자체가 미국의 GP10 규정을 위반하는 행위가 될 수 있음을 경고한 것이다.48

현재 화웨이의 Ascend 칩이 사실상 Nvidia GPU의 유일한 대안으로 부상하고 있는 상황에서 55, 이 조치는 중국의 AI 자립 생태계를 원천적으로 고사시키려는 정밀한 전략적 의도를 담고 있다.54

3.4 자본 통제: 대중국 해외 투자 스크리닝 (OIR)의 본격화

이 프로그램의 핵심 목표는 미국의 동맹국 및 우방국에 미국의 ‘풀스택(full-stack) AI 패키지’ 수출을 정부 차원에서 적극적으로 장려하고 지원하는 것이다.12 이 ’풀스택’에는 단순히 하드웨어(반도체, 서버)와 소프트웨어(AI 모델, 애플리케이션)뿐만 아니라, 투명성, 책임성 등 미국의 가치와 표준이 반영된 거버넌스 모델까지 포함된다.69

이를 위해 정부는 AIexports.gov라는 별도 웹사이트를 개설하고, 산업 주도 컨소시엄을 구성하며, 국무부와 상무부의 전 세계 외교 및 상무관 네트워크를 총동원하여 ’신뢰받는 해외 구매자’와 미국 AI 기업들을 연결시키고 있다.65 2025년 10월 ASEAN 정상회의에서는 한국, 일본 및 동남아 국가들과 AI 수출 및 핵심 광물 공급망 협력을 위한 프레임워크가 발표되기도 했다.22

이러한 전략은 중국의 ’디지털 실크로드’에 대항하는 ’AI판 마셜 플랜’으로 분석된다. 이는 III-A~D 섹션에서 분석한 ‘봉쇄(Deny)’ 전략과 동시에, 동맹국에 자국 기술을 적극 보급하는 ‘확산(Diffuse)’ 전략을 구사하는 것이다. 이는 단순한 상품 판매를 넘어, 동맹국들에게 ‘안전하고 신뢰할 수 있는(미국산)’ AI 인프라를 제공하는 대가로, 이들을 미국 중심의 기술 블록에 편입시키고 장기적으로는 미국 기술 생태계에 대한 의존도를 심화시키려는 전략이다.68 이는 한국과 같이 독자적인 ‘소버린 AI(Sovereign AI)’ 역량을 추구하는 국가들에게 상당한 전략적 압박으로 작용하고 있다.1

4. 제2전선 (대내): 연방-주 정부 간 AI 제품 규제 충돌

대외적으로는 강력한 기술 통제에 나서는 미국이지만, 대내적으로는 연방 정부의 규제 완화 기조가 주(State) 정부의 활발한 입법 활동과 충돌하며 극심한 혼란, 즉 ‘규제 패치워크(Regulatory Patchwork)’ 현상을 겪고 있다.

4.1 연방 차원의 규제 완화: NIST RMF 및 고용 지침 철회

이러한 연방 정부의 ‘규제 완화’ 조치는 역설적으로 미국 내 기업들의 ’법적 위험(Legal Risk)’을 증가시키는 결과를 초래했다. 2024년에 제정된 콜로라도 AI 법(SB 205)을 비롯한 다수의 주(State) 법안들은, 기업이 NIST AI RMF를 “실질적으로 준수“할 경우, 법 위반에 대한 ‘반증 가능한 추정(rebuttable presumption)’ 즉, 일종의 ’안전항(Safe Harbor)’을 제공하는 조항을 포함하고 있다.23 이는 기업들이 자발적으로 NIST RMF(편향성, 공정성, 안전성 포함)를 따르도록 유도하는 강력한 인센티브였다.

  • 기만 행위 및 딥페이크: AI를 사용한 개인 사칭(impersonation) 82, AI가 생성한 가짜 리뷰 및 평가 82, AI 기반 로보콜(robocall) 등 기만적 마케팅 행위를 적극적으로 단속하고 있다.82

  • 데이터 오용: 기업이 불법적으로 수집한 소비자 데이터를 AI 모델 훈련에 사용하는 행위를 금지하고 있다.82

  • 허위·과장 광고: AI 콘텐츠 탐지 제품의 정확성이나 효능을 허위로 광고한 기업(Workado, LLC)에 대해 제재 조치를 최종 승인했다.80

4.3 ‘규제 패치워크(Regulatory Patchwork)’: 주(State) 정부의 독자 입법 가속화
